What Makes This Different for Americans
FATCA filter: The Foreign Account Tax Compliance Act (FATCA) requires foreign financial institutions to report US-citizen accounts to the IRS. Most small Portuguese fund managers find this overhead unprofitable and refuse US investors at intake. Of ~50 active Golden Visa qualifying funds, only ~6 actively onboard Americans.
PFIC filter: Passive Foreign Investment Company rules trigger punitive US tax treatment on most foreign mutual funds and ETFs. However, Portuguese venture-capital and private-equity Golden Visa funds typically invest in operating businesses, not securities — making them non-PFIC. We obtain the fund's legal opinion in writing before recommending.
Currency hedging: EUR 500K commitment is held in euros. Dollar-strong vintages (2022 -- 2025) have been favorable; we discuss hedging options for clients concerned about FX exposure during the 5-year hold period.
